Terms of sale
The rules for buying from us, in plain words. Pricing, freight, tax, payment and returns.

About these terms
These terms apply to orders placed with Western Building Materials, LLC ("WBM", "we", "us"). Placing an order means you accept them. For the day-to-day detail, see shipping, will-call and returns.
Prices
Prices on the public price list are in US dollars. They are per piece, and pipe is per stick. Prices do not include sales tax or freight.
Prices can change. The price that applies to your order is the one we confirm to you. A written quote is valid for a set number of days, shown on the quote.
If a price or a product detail is wrong, we may correct it and contact you before the order ships.
Public price list and wholesale accounts
The public price list is for small buyers. There is no minimum order. Orders under $750, and customers without a wholesale account, use the public price list.
Wholesale pricing is for approved accounts only, on a single order of $750 or more. There are three price columns, set by the merchandise total of the order: $750 to $2,499, $2,500 to $7,499, and $7,500 and up. The prices are the same for every wholesale customer, wherever located, and for pickup. We email the wholesale price list to approved accounts. It is not posted on this site.
Wholesale fittings are sold by the full carton only. We do not break cartons. Pipe is sold per stick.
To open an account you need a business tax ID (EIN), your business license (and a contractor license where one is required), and a resale certificate for tax-free purchases. To apply for credit terms you also need a credit application and two trade references. Open a wholesale account.
Orders and acceptance
We accept an order when we confirm it to you by email or phone. We may decline an order or limit quantities.
Freight, pickup and risk of loss
Prices are FOB our Salt Lake City warehouse. Freight is never included in a product price. We bill the actual carrier cost as a separate line, the same way for every customer.
You can pick up at our counter, send your own truck or carrier to our dock, or have us arrange shipping. If we arrange shipping, we quote the freight before the order ships. Carrier extras such as lift-gate, residential or limited-access delivery and overlength pipe are passed through at cost.
Risk of loss passes to you when the goods are loaded onto your vehicle or handed to the carrier. Will-call orders must be picked up within 72 hours of the ready notice.
Inspection and claims
Check your delivery when it arrives. Note any visible damage on the delivery receipt. Report damage or shortage to us in writing, with photos, within 5 business days of delivery. We help you file carrier claims.
Taxes and resale certificates
Utah sales tax applies to goods delivered or picked up in Utah, unless we have a valid resale or exemption certificate on file before the purchase.
Payment and credit terms
For public price list orders, we confirm the accepted payment methods when we confirm your order.
New wholesale accounts pay their first orders by prepayment, by card or ACH. After credit approval, payment is due net 30 from the invoice date, within your approved credit limit.
Terms for late payment, such as late fees and collection costs, are to be added.
Returns
You may return an item because you changed your mind within 30 days of the invoice date, with our authorization first. We take back full, unopened, resalable cartons only. A 25 percent restocking fee applies, and you pay the return freight.
If an item is defective or we shipped the wrong thing, there is no restocking fee. We pay the return freight and replace the item or refund you.
A will-call order not picked up within 72 hours of the ready notice is treated as a return, and the restocking fee applies.
Special-order items
Special-order items cannot be returned. Cut pipe and anything used or installed cannot be returned either.
Product warranty
Warranty wording is to be decided with counsel and John. Nothing is published here until then.
Limits on our responsibility
You are responsible for choosing the right product for your job. Check the pressure rating, the temperature and your local code. DWV fittings are for drainage and venting only. They are not for pressure or potable water.

Governing law
These terms and every sale under them are governed by the laws of the State of Utah.
Changes to these terms
We may update these terms. The version in effect when we accept your order applies to that order.
